New trademark fees in Benelux
This week, the Benelux Office for Intellectual Property (BOIP) announced it will follow EUIPO’s fee structure as of January 1, 2019 by introducing a fee-per-class system.

As of 2019, trademark owners pay per class in Benelux

Nowadays, the official fees for an application or renewal up to three classes are the same. Per January 1, next, the trademark holder pays per class. Similar to EUIPO, this is based on the argument that the register gets cluttered with non- or less relevant classes and by raising a financial threshold, the number of registered classes will decrease. In addition thereto, as the official fees for an application or renewal in one class remain more or less the same compared to the current three classes, this change will also incur additional revenues for BOIP.

Turnstone advises to have Benelux marks, whenever possible, filed and/or renewed by the end of this year instead of in January.
